4. Disclosure of Information

a. Service Providers

a. No Warranty or Guarantee

  1. The Service is provided on an "as-is" and "as-available" basis without any representations, warranties, or conditions of any kind, express or implied.
  2. First Responders Technology Limited expressly disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, and performance.
  3. We make no guarantees regarding accuracy, reliability, completeness, or timeliness of the information or results provided by the Service.

b. Disclaimer of Liability for Health Outcomes

  1. Users acknowledge that the health insights, reports, or recommendations generated by the Service are for informational purposes only and are not intended as medical advice or a substitute for professional consultation.
  2. First Responders Technology Limited is not liable for any health-related decisions, actions, or outcomes arising from the use of the Service, including but not limited to adverse health conditions, misdiagnoses, or treatment plans.

c. Limitation of Damages

To the fullest extent permitted by law:

  1. Limited shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:
    • Loss of profits, revenue, or anticipated savings.
    • Loss of data, use, or business opportunity.
    • Damage to reputation or goodwill.
    • Costs of substitute goods or services.
  2. Our total cumulative liability, whether in contract, tort, or otherwise, is strictly limited to the total fees paid by the user for the Service during the twelve (12) months preceding the claim.

d. User Responsibility and Assumption of Risk

  1. Users agree to use the Service at their own risk and assume full responsibility for evaluating the accuracy and suitability of the health insights provided.
  2. Users acknowledge that uploading lab results or health data involves inherent risks, and we cannot guarantee error-free processing or protection against unauthorized access.

e. Third-Party Services

  1. The Service may integrate with or rely upon third-party services, such as payment processors, hosting providers, or external labs. We disclaim all liability for any issues, data breaches, or damages caused by such third-party services.
  2. Users agree that First Responders Technology Limited is not responsible for disputes, errors, or damages arising from interactions with third-party systems or services.

f. Force Majeure

First Responders Technology Limited is not liable for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, cyberattacks, or technical failures.

g. Indemnification

Users agree to indemnify, defend, and hold harmless First Responders Technology Limited, its officers, directors, employees, contractors, limitations and exclusions of liability in this section apply to all claims, regardless of jurisdiction or legal theory. If any provision of this section is deemed unenforceable in a particular jurisdiction, the remaining provisions shall remain fully enforceable to the maximum extent permitted by law.

7. Dispute Resolution

a. Governing Law

These Terms are governed by the laws of Jamaica.

b. Arbitration Clause

All disputes will be resolved through binding arbitration under the rules of the Jamaican Arbitration Association.

c. Waiver of Class Actions

You waive any right to participate in a class action or similar collective legal process.

8. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion.

9. Modifications

We may update these Terms periodically. Continued use of the Service constitutes acceptance of any changes.
